SUBMISSION PERIOD. Giveaway submissions will be accepted December 14, 2023 at 12:01 a.m. PST through December 20, 2023 at 11:59 p.m. PST.
ELIGIBILITY. Legal residents of the 50 United States, and the District of Columbia, 18 years of age or older are eligible to enter, except employees of Sponsor, Reflect Beauty and its parent Mirror Digital, and any other organizations affiliated with the sponsorship, fulfillment, administration, prize support, advertisement or promotion and/or their respective agents, affiliates, subsidiaries, and members of their immediate families or persons residing at the same address.
HOW TO ENTER. To enter the Sweepstakes and to qualify for Entry, Entrant must: (i) have an Instagram account; (ii) follow Sponsor Account on Instagram (@_reflectbeauty_); (iii) have an internet connection; (iv) be considered a member in good standing with Instagram, LLC, as determined by Instagram, LLC in its sole discretion; and (v) follow the instructions in the call to action relating to #REFLECTBEAUTYGIVEAWAY provided in any Instagram message posted by Sponsor that indicates there is a chance to enter to win Prize(s), including tagging two (2) friends on the @_reflectbeauty_ post, and typing the exact unique term called for in Sponsor’s post calling for entries (“Entry”). Sponsor, at its sole discretion, may accept a technically incorrect unique term. For the avoidance of doubt, Entrant’s Entry must be a separate post on Entrant’s Instagram Account referencing the Sweepstakes advertised on Sponsor’s Instagram account (i.e., “@_reflectbeauty_”). Any posts that do not appear as a response on the Entrant’s Instagram Account to the specific post calling out the Sweepstakes on Sponsor’s Instagram account will not be entered into the Sweepstakes. NOTE: If Entrant’s Instagram account is set to “protected mode” or “private,” Entrant’s Entry may not be visible to Sponsor and may not be received by Sponsor. All Entries must be submitted by the end of the Sweepstakes Period listed above. Sponsor and Administrator will not be responsible for lost, stolen, misplaced or misdirected entries.
NOTE ABOUT “PRIVATE” OR “PROTECTED MODE”: Sponsor may not receive entries from Instagram users with “protected” or “private” updates (i.e., user has set their account so that only people the user has approved can view their updates) due to the way Instagram operates its service.
Entries generated by a script, computer programs, macro, programmed, robotic or other automated means will be disqualified. Entries that are incomplete, illegible, corrupted, false, lost, late or misdirected, deceptive, profane or otherwise not in compliance with the Official Rules may be disqualified from the Sweepstakes at Sponsor’s sole and absolute discretion. As a condition of entering the Sweepstakes, each Entrant (or if the Entrant is a minor, said Entrant’s parent or legal guardian) gives consent for Sponsor to obtain and deliver his or her name, address and other information to third parties for the purpose of administering this Sweepstakes and complying with applicable laws, regulations and rules. In the event of a dispute over the identity of an Entrant, entry will be deemed submitted by the authorized account holder of the e-mail address associated with the Instagram account of the entry, which the Entrant will have the obligation to establish. The “authorized account holder” is defined as the person assigned to an e-mail address by an Internet access provider, online service provider and/or other organization responsible for assigning e-mail addresses. All materials submitted become the property of Sponsor and will not be returned. In the event a dispute regarding the identity of the individual who actually submitted an entry cannot be resolved to Sponsor’s satisfaction, the affected entry will be deemed ineligible. Illegible and/or incomplete entries and entries submitted by Entrants who do not meet the eligibility requirements (including all requirements with respect to age and residence) are void.
NOTE ABOUT MOBILE: If Entrant opts to receive Sponsor’s Instagram updates via Entrant’s wireless mobile device (which may only be available via participating wireless carriers and is not required to enter), data charges may apply for data sent or received from Entrant’s handset according to the terms and conditions of Entrant’s service agreement with Entrant’s wireless carrier. Other charges may apply (such as normal airtime, data charges and carrier charges) and may appear on Entrant’s mobile phone bill or be deducted from Entrant’s prepaid account balance. Wireless carriers’ rate plans or data plans may vary, and Entrant should contact Entrant’s wireless carrier for more information on messaging rate plans and charges relating to Entrant’s participation in this Sweepstakes. Participation in this Sweepstakes by mobile phone means that Entrant understands that Entrant may receive additional data from Sponsor relating to this Sweepstakes, including to notify Entrant if Entrant is a potential winner in this Sweepstakes, which will be subject to the charges pursuant to Entrant’s carrier’s rate plan. Use of Instagram may not be available from all mobile phone service carriers and handset models. Cell phone service may not be available in all areas. Entrant should check Entrant’s phone’s capabilities for specific instructions.
Sponsor and Administrator reserve the right to cancel, terminate, or modify any entry not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, force majeure, or technical failures of any sort. Submissions that do not comply with these Official Rules will be void, eliminated and not eligible for consideration.
Entrant can announce via tweet, or Instagram social media post their participation in the Sweepstakes by sharing the official Sweepstakes Social Media Post issued by Sponsor to Entrant to invite others to participate in the Sweepstakes.
Giveaway. The Reflect Beauty NYX Giveaway will be hosted online (the “Giveaway Date”) between December 14, 2023 through December 20, 2023. The Sponsor will not be responsible for failed attempts to contact a selected Giveaway entrant. Limit of one (1) prize per person.
ODDS. Odds of being selected for a prize depend on the total number of eligible entries received by the Giveaway Closing Date. When you enter the Giveaway online, you can also opt-in to receive promotional offers and emails from Sponsor. You can opt-out of receiving such offers and emails at any time and opting-in does not impact your chances of winning.
PRIZE. On, or about, December 22, one winner will be selected to win a special prize pack consisting of NYX products including: Lippie in Flaunt It, Lippie in Gettin it Caliente, Concealer, Edge Brush, Mascara.
LIMITATIONS ON PRIZES. Sponsor reserves the right to substitute a prize (or portions thereof) of equal or greater value if prize (or portions thereof) cannot be awarded as described. Sponsor will determine all elements of prizes at its sole discretion. All prizes will be awarded unless there are fewer entries than prizes, in which case all remaining prizes will be donated to charity. Prizes may not be assigned, transferred, changed or redeemed for cash, except at the sole discretion of Sponsor. Grand Prize winner will also be required to complete and return a Winner Release form granting Reflect Beauty permission to print your image, confirming compliance with the official rules, acceptance of a prize as awarded, without substitution, and releasing the Sponsor, Reflect Beauty, their affiliated and related companies, advertising and promotional agencies, the independent Giveaway organization and their respective shareholders, directors, officers, employees, agents, representatives, successors and assigns (collectively, the “Released Parties”) from any liability in connection with a prize or the Giveaway. The Affidavit and Release Form must be returned within the time period specified on the Affidavit and Release Form or the prize will be forfeited. The awarding of any prize is contingent upon full compliance with these Official Rules. Entrants agree to be bound by Official Rules. Entrants understand that Sponsor is not liable for injuries, losses or damages of any kind arising from participation in this Giveaway and acceptance, possession and use of prize. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Giveaway or in the announcement of the prizes. Decisions of Sponsor are final and binding in all respects.
PRIVACY. Information collected from online entrants is subject to Sponsor’s privacy policy at https://reflectbeauty.com/privacy/
DISPUTE RESOLUTION. Except where prohibited, by participating Giveaway entrants agree that: all issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of participant(s) and Sponsor and its agents shall be governed by and construed exclusively in accordance with the laws of the State of California without giving effect to any principles of conflicts of law of any jurisdiction. Entrant agrees that any action at law or in equity arising out of or relating to this Giveaway, or awarding of the prizes, shall be filed only in the state or federal courts located in the State of California and entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such action. Except where prohibited, by participating in this Giveaway, each entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Giveaway, or awarding of the prizes, shall be resolved individually, without resort to any form of class action; and (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Giveaway but in no event attorneys’ fees; and (c) under no circumstances will any participant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Some jurisdictions do not allow the limitations or exclusion of liability for incidental or consequential damages, so the above may not apply to you.
OTHER. Sponsor assumes no responsibility for entries it is unable to process due to network, hardware or other technical failures, or any other reason, or incomplete, damaged, misdirected, illegible, stolen or lost entries. Sponsor reserves the right, in its sole discretion to disqualify any person tampering with the entry process, the operation of the website or otherwise, in violation of the rules. Sponsor reserves the right to disqualify any non-conforming entries. Sponsor further reserves the right, in its sole discretion, to cancel, terminate or modify this promotion if not capable of completion as planned, including infection by computer virus, technical corruption, non-authorized human intervention or force majeure. In the event of cancellation, Sponsor reserves the right to select winners from among all eligible entries received prior to the date of cancellation. The use of automated entry systems or any other conduct that impedes the integrity of the Giveaway is prohibited. In the event of a dispute regarding online entry, entry will be deemed made by the holder of an established e-mail account associated with the entry.
GENERAL. Except where prohibited by law, entry constitutes permission to use Winner’s name, hometown, voice, likeness, photograph, and any statements regarding this Giveaway for editorial, public relations, promotional, and advertising purposes on behalf of Sponsor without compensation. By participating and winning a prize, winners release Sponsor, Reflect Beauty, and their parents, affiliates, subsidiaries, and agencies, and their respective directors, officers, employees, and agents from any and all liability with respect to the prize won and participation in the Giveaway, subject to all federal, state and local laws and regulations. Void where prohibited. Taxes on prizes are the sole responsibility of winners.
For winners’ names, available after December 25, 2023, send a separate, self-addressed, stamped envelope to Reflect Beauty X NYX Cosmetics Winners’ List to Mirror Digital, 8704 South Sepulveda Blvd, #1094, Los Angeles, CA 90045. Requests must be received no later than February 1, 2024.
